In this year’s problem, we will touch on one of the most recently discussed topics in ISDS: whether sanctions may constitute breaches of investment treaty protections and what jurisdictional challenges the parties may encounter in bringing sanctions-related claims before international investment tribunals.

The case will also explore the complex ownership and control tests under the EU regulatory framework and will carefully study the peculiarities of the EU sanctions regimes.
